PUBLIC COMMENT

SIMPSON LUMBER COMPANY

Comment Period: February 22, 2010 - March 25, 2010

What is the proposal?

Simpson Lumber Company (SLC) has requested the Puget Sound Clean Air Agency issue a regulatory order establishing federally enforceable limits for regulated air pollutants from their spray coating facility located at 901 E. 11th in Tacoma.  The proposed regulatory order will limit SLC’s potential emissions of volatile organic compounds (VOC) to less than 99.0 tons and emissions of hazardous air pollutants (HAP) to less than 24.5 tons for any consecutive 12-month period.  New information regarding emissions of VOCs and HAPs from lumber drying kilns shows that historical production levels could result in SLC being classified as a major source of HAPs.  As a result, SLC is requesting a federally enforceable limit of VOC and HAP emissions to enable the facility to be excluded from the air operating permit program codified in Chapter 173-401 of the Washington Administrative Code.  SLC is also currently subject to the requirements of the Plywood National Emissions Standards for Hazardous Air Pollutants (Plywood NESHAP), codified in 40 CFR 63 Subpart DDDD.  Approval of SLC’s request to establish a federally enforceable limit of VOC and HAP emissions will not affect SLC’s requirements under the Plywood NESHAP.

PRELIMINARY DETERMINATION

The Puget Sound Clean Air Agency has completed review of this request.  The Agency has no objection to issuing this Order pursuant to Section 3.03 of Regulation I and WAC 173-400-091.  The Agency has also made a preliminary determination that the proposal would not have a probable significant adverse impact on the environment (determination of nonsignificance).  This action is a non-project action.  The agency has completed an Environmental Checklist which is on file at the Agency.  This information is available to the public upon request.  The Determination of Non-Significance (DNS) for this proposal is issued in accordance with WAC 197-11-340(2); the Agency will not act on this proposal before March 25, 2010.
